In 2016, the Republicans argued the Senate should not consider Obama’s Supreme Court nominee, Merrick Garland, because the vacancy happened just 269 days before the election… Now, with the election just 45 days away, the Republicans seem to fee differently…

I’m sorry that I haven’t been around much this past week, but I’ve had my hands full. I did want to stop by the site today, though, and announce that, even though I’m soon to be on the unemployment line, I’m going to be making a contribution to the Senate campaign of retired US Marine Corps Lieutenant Colonel Amy McGrath this evening in honor of Supreme Court Justice Ruth Bader Gisburg, who passed away earlier this weekend at the age of 87, after a long battle with pancreatic cancer.

Why, you might ask, am I marking the death of the great jurist Ruth Bader Ginsburg by giving money to the political campaign of a former Marine… Well, the answer is easy. I’m giving money to Amy McGrath because Mitch McConnell, her opponent in this year’s Senate race in Kentucky, is a despicable, lying sack of shit — who, as I write this, is actively attempting to steal yet another Supreme Court seat — and I would like nothing better than to have McGrath end his reign of evil once and for all. [McGrath is still behind in the polls, but she’s gaining.]

McConnell, as you might recall, argued in 2016 that President Obama should not be able to get a hearing on his Supreme Court nominee, Merick Garland, as it was too close to the presidential election. As Scalia had passed away 269 days before the 2016 election, McConnell said, we should give the American people a voice, and wait for the next president to make a nomination. Here’s the letter from his office explaining why Garland wouldn’t be given a hearing in the Senate.

And here’s the absolutely shameless Mitch McConnell today, saying that Donald Trump’s nominee should get a vote in the Senate despite the proximity to the election. [Apparently 269 days was too close to the election, but 46 days is acceptable. There, by the way, has only been one Supreme Court vacancy closer to a presidential election than this one, and that was in 1864.]

There is no shortage of Republican hypocrites on this subject. Republican Senator Ted Cruz, who now says that Trump should be able to have his nominee considered, said back in 2016, “We have 80 years of precedent of not confirming Supreme Court justices in an election year [Cruz, by the way, was wrong. Justice Kennedy have been confirmed in 1988, which was an election year.] And Senator Lindsey Graham tweeted out the following.

Graham and Cruz, for what it’s worth, are both on the Senate Judiciary Committee, as are Republican Senators Cornyn, Ernst, Tillis, and Grassley, all of whom have given us their word that they would not vote to nominate a Supreme Court nominee in an election year. Here, for instance, is Lindsey Graham saying, “If an opening comes in the last year of President Trump’s term, and the primary process has started, we’ll wait to the next election.”

And this is the same Lindsey Graham who just said yesterday, “I will support President DonaldTrump in any effort to move forward regarding the recent vacancy created by the passing of Justice Ginsburg.”

We always knew that this would happen. We knew the the argument they used to deny Obama his ability to name a nominee was complete and total bullshit. McConnell even laughed about it a little while ago, when he said that, if a vacancy were to open up before the election, he’d support Trump in filling it. Here, for those of you looking for yet another reason to despise McConnell, is that tape.

Personally, I’m terrified of how this will all play out, but I’m hoping that the folks at the Lincoln Project are right when they predict that this naked power play will be “the final nail in Trump’s political coffin, doom the campaigns of Senators such as Cory Gardner and Susan Collins and end the Republican’s Senate majority.”

Joe Biden came out today calling on Republicans in the Senate to do what they know is right, and “(refuse to confirm anyone) nominated under the circumstances President Trump and Senator McConnell have created.” So far, to my knowledge, only Susan Collins of Maine has come forward to say that she does not think that the Senate should consider Trump’s nominee, whomever it might be. She, of course, also said that she had serious concerns about Kavanaugh, only to ultimately vote for him.

I know it doesn’t do any good to point out the hypocrisy of the right. Anyone who still considers themselves to be a Republican after everything we’ve seen these past four years clearly doesn’t care. Hopefully, though, at least a few of you are inspired by this post to join me in investing a few dollars to the campaign of McCain’s adversary in my home state of Kentucky… Nothing that Donald Trump has done to our nation could have been done without the support to Mitch McConnell. If one thing sticks with you from today’s post, let it be that… Mitch McConnell is a small, evil man who only cares about power, no matter what the cost to our democratic institutions. And he has to go… I’m doubtful that Kentucky will do the right thing come Election Day, but I’d like to think, at the very least, McConnell might be weakened, and lose his role as Majority Leader. That would make me incredibly happy.

In the name of Ruth Bader Ginsburg, let’s all do the right thing today, and do something tangible to ensure that hypocrites like these are once and for all driven from power. [If you’re not giving directly to McGrath, consider a donation to Crooked Media’s Get Mitch or Die Trying campaign, which is investing in campaigns across the nation in hopes of flipping the Senate and removing McConnell from power.]

The left knows that the will of the people is expressed through the candidates they elect. That the Senate would not confirm a Supreme Court Justice nominee of an outgoing President of the opposite party is expected. Quite a different scenario when the Senate and President are of the same party. And it is critically important to stop the slaughter of the unborn children in the womb only because their parents might consider them an inconvenience.

The SCOTUS nominee is a done deal. We who care about reproductive autonomy (male and female) need to start strategizing other approaches. We must win the Senate and the presidency and pass federal laws legalizing abortion. Roe v Ware was a weak decision, always vulnerable as I heard RBG say herself speaking at UM. We need to man up and go to the polls and protect and preserve the right to privacy and bodily autonomy from the hijacking of the Judicial Branch by Christian conservatives.

It’s the only way. We need to own the other branches. A properly written law protecting the right to abortion or ending corporate personhood would not be disabled by the court.

This election which should hinge on any number of other urgent issues will now hinge on the wedge issue of abortion. We have the numbers of voters on our side. They seem to have the will to vote on their side. We need to vote like our lives depend on it. Because they do.

Jean, you are right. My hope is that younger women (and their male allies) will realize that if they get up and vote, they can make real changes that are such that the SCOTUS cannot undo them. Also I expect that every Republican who is currently saying that there is no hypocrisy will not start accusing Biden and the Dems of hypocrisy if they get into power and expand the number of seats on the court in order to ensure that the court will not make half of the country second-hand citizens.

Let’s make no mistake about that either. EOS may be an exception (but I doubt it) but by and large, the abortion debate is not at all about “saving babies”. They all know that a fetus is not a baby, I don’t see Republicans giving citizenship to fetuses. When they were voting for a COVID stimulus package that included $500 for every child, they did not include fetuses. They do not consider fetuses to be children unless they are trying to make their anti-abortion position seem respectable. That whole fake “pro-life” schtick is to divert people from realizing that their true mission is to subjugate women and make it so they have fewer civil rights than men do.

My hope is that some of those non-voters get off their asses and get to the polls. 77% of Americans support reproductive rights. I think if we could pass the ERA (very possible if the Dems get control of both houses), it would make Roe V Wade moot because there is no way to establish that women are equal under the law if one is going to impose such restrictions on her medical decisions. heh.

Every time I encounter some younger woman talking about how she thinks Biden is too old or too boring or too whatever, I just say “vote how you would like, it isn’t MY right to an abortion that is on the line as I have had a hysterectomy last year but know this: Elections have consequences”

I did go off a bit on Michael Moore this weekend. That asshole is talking about how NOW Dems have to work together. Big FUCK YOU to Moore and anyone else who didn’t vote for HRC in 2016!

  16. Posted September 21, 2020 at 10:38 am | Permalink

On the brighter news side: technology will ensure that women retain access to abortions in that the internet has lots of information available and today’s abortifacients are much safer than the wire hanger abortions of yesteryear. Still not as safe as medically supervised abortions and the ironic consequence of abortion bans is that they don’t eliminate abortions but instead make it more likely for women to die. What was that about being “pro-life” again? You can’t ask for a more pro-death group than the GOP.

wage gap issues are seriously complex. I am very sure that wobblie is incorrect that women earned 67 cents to every dollar men earned 50 years ago. Some quick googling says that in 1970 the wage gap was 47 cents to every dollar.

So these days I think it is more like 82 cents to every dollar. And no, that is not a wage gap that only includes comparing similar jobs. It is the overall median wage of all women compared to the overall median wage of all men. I would say that 47/100 to 82/100 shows us just how much improvement can come from gradual change especially in this case where a good chunk of the wage gap comes from the cultural expectations of women. i.e. women are still generally expected to take on most of the childcare, eldercare, and homemaking tasks and like it or not, those things affect earnings. Women are also often encouraged to go into historically female-dominated professions and those pay less. There is also some discrimination on the part of employers but you tend to see that more when you break out wage gaps by race or even age!

Let’s not forget though one of the main reasons why that wage gap closed as much as it did. It was Ruth Bader Ginsberg. The cases she argued in the Supreme Court as well as ones she ruled on as judge. All women owe a lot to her.

I heard women don’t negotiate as well as men when it comes to pay. Then though it is not a fault they tend to take more time off to raise children. If there is a gap in employment it might tend to reduce their experience in comparison.

upscale liberal white woman of course want to believe there has been more progress than there has been. Kinda like black folks got it so much better now than 50 years ago too. For example women make up about 62 percent of at-or-below minimum wage workers. But arguing about the extent of inequality is kinda like arguing about body counts.

There is an obvious way to correct this inequality.

GEO Makes Gains in Historic Strike (via AFT Michigan email)
Last Wednesday evening, GEO members voted to accept the agreement negotiated with the University of Michigan administration and end its strike that began on September 8. The union won an expedited process for resolving GSI’s concerns about virus-related safety, additional funding and expanded coverage for daycare, the right to instruct students in classes to wear
masks and cancel class if a student refuses to comply — as well as information about PPE availability and the methodology of the University’s COVID-19 testing program. The local will now also have a series of meeting with members of the University’s Board of Regents to discuss public safety and policing at the University, as well as a seat on a task force created to assess policing. The agreement also included a no reprisals clause.
Support for the strike grew rapidly, with hundreds of members and supporters walking picket lines and the local holding the biggest membership meetings in its history (over 1,200 people attended the strike ballot meeting over zoom). During the strike, union membership increased from 54% to 67%, and inspired resident hall dorm Resident Advisors to conduct their own strike for increased COVID-19-related safety measures. The RAs settled their strike this past weekend.
In a statement following the vote to end the strike, GEO said it would not stop its organizing efforts. “We’re not going anywhere. We’re not giving up,” the statement read.

Yes, HW. It is true that there are studies out there that show that women are less likely to negotiate their salaries. It is also true that women take more time out of the workforce than men to take care of children or elderly parents. It is well established that not being in the workforce for a period of time (for any reason) does negatively affect a person’s earnings for the rest of their lives. Possibly due to decreased exposure to workplace skills but I am not always so sure since a lot of stay-at-home parent skills seem very transferable to the labor market.

The progress of feminism over the past 50 years is very visible to me. I remember how the world was when I was a child and it was actually worse than I remembered in that many aspects of a society are too advanced for a young child to grasp. When I was a kid, women were nurses, teachers, librarians, social workers, secretaries, maids, waitresses, and housewives. Things are different now although there is still some truth in that old joke about the pay gap.

Women earn less than men because they choose feminine professions like female ceo, female engineer, female doctor, female lawyer, etc.

When I was a kid Lynne woman did lots more than your 5 year old memory retained. My mother for example worked in a clothing factory. Princess Peggy, she became President of her local union. And in typical liberal style you blame the victim for the systematic discrimination woman experience. It is because they left the work force, it is because they lack skills, it is because of the occupations they choose to work in. . It is not the system/culture that maintains discriminatory practices, It is woman fault they are discriminated against. Victim blaming is engrained in the liberal psyche.
It is black folks fault that they are discriminated against. If only they were not so angry all the time.
It is workers fault for choosing to be workers. Employers create the jobs, and are much more important.
It is voter fault for not voting the liberal way. It is there fault that we have Trump.
Meanwhile over 20 million American woman are living in poverty. It is possible to map out the disproportionate number of woman living in poverty versus males living in poverty. Lynne, wanted to thankyou for making me think about the woman in the neighborhood I grew up in. I lived on a pretty short street, only two blocks long. Most of the woman were “housewifes” some of the time. Several worked assembly at the Motorola factory. Claire and her husband Paul worked at the clothing factory with my mom. Claire was her VP and Paul was the Secretary. A little bit of gender role reversal there. Then my mom’s best friend down the street was Lorraine. She was thought of as a wild woman with her flaming red hair and the little Austin Healey she would drive around in. She was a professional photographer and entrepreneur ultimately owning a pipe and tobacco shop. Her son inherited the establishment. Then across the street was Becky Linderman. She was a test/stunt pilot. Her husband built her a bi-plane in the garage. It was quit a site when she would test drive it down the street. She took me on my first airplane flight. Next door was Mrs. Schmidt, always very formal with her. She was a refugee from the failed Budapest uprising. She worked at the University in some capacity.
My moms sisters all had more “traditional” woman’s”jobs. Three were nurses, and one was a hair stylist.
When I was young we had “affirmative action”, ie. a duty to if not to revers then ameliorate the effects of systematic discrimination. We threw that aside in favor of “equal opportunity”.

wobblie, I am so not blaming women but rather pointing out that things are deeper than you might think. You may not like it but there is no getting around that women earn less money than men because they choose to drop out of the workforce. I am not blaming them but rather pointing out that we have pretty big societal expectations of women that we don’t have for men and those things are the issue more than overt discrimination these days although discrimination is still an issue in many professions. i.e. let’s ask ourselves WHY women choose to drop out of the workforce more than men do. Is it because they are expected to raise the children? Expected to keep the house? Expected to care for elders?

I get it though that the work of feminists like RBG mostly benefited upper-class white women but that is due to larger trends I think where not only the working class but the middle class too has been losing ground income-wise. Still, you cannot deny that there have been huge improvements in the wage gap!

Maybe wobblie, you should ask yourself why you feel a need to mansplain on this topic to me when I

Lynne I recommend you do some studies in comparative economics. Pay woman for the social labor they perform. Nordic countries figured this out. Socialist countries figured this out. I do not and never claimed to “know” more than you. But I’m not stupid, only a little slow on the uptake. I am not” mansplaning” when I speak up about sexism. Because my wife is a tenured professor at an R1 research institution running an international research program and is paid half of what some of the useless pricks around her make. Because almost every important person in my life is a female. Because my wife is my partner, I have learned to recognize the daily assaults that her dignity is confronted with. Because I have a daughter who I would like to see inherit a better world than this, I think it is important to speak up, and point out its been along time, and this system still fails to deliver.

Interesting interview with Col. Wilkerson. He is a life long Republican and one of the few people who served in the Bush II administration who left with his integrity intact. He was a participant in the Transition Integrity Project.

You are totally mansplaining, wobblie. Most recently with your assumption that I have not studied the economic systems of Nordic countries. I have. I like what they do. It is one of the reasons why I liked the economic plans proposed by Elizabeth Warren recently in her presidential run. Still, the wage gap in some Nordic countries is similar to that we experience in the USA.

I get it that straight-up discrimination is still an issue. I am sorry that your wife may be experiencing it. It just isn’t enough of an issue to explain the entirety of the wage gap in this country.

I don’t want to restrict abortion, I want to abolish it. I don’t think women she put jailed for life. I think that doctors who perform abortions should have to pay enormous fines and then have their licenses revoked.

I’m not concerned with what a woman does with her body. My concern is with the other body growing inside. The fetus has a unique genome and is a separate and distinct individual. A mother should never be allowed to kill her children. There is nothing more evil.

Some researchers wouldn’t use a CT over 30. Every 3.3 cycles is a ten-fold increase in sensitivity so a CT of 40 is 1,000 times more sensitive than a max of 30. It should definitely no more than 34 they say. It is absolutely not a YES/NO test. The higher the CT the lower the viral load. That’s how it works. You and your abuse and mountain of lies are done.

Under what circumstances do you think deaths could not be “discounted” if they could not have had the disease? It’s the simplest common sense that you cannot die from a disease you do not have.

There is no reason to use 40 cycles of PCR unless you cannot detect a viral load with a reasonable number. The fragments that are being detected in these tests are so insignificant they pose no risk. I posted the research. You sound like an idiot not being able to respond to it but still spewing nonsense.

Today in the slippery slope towards totalitarianism:

The Federalist society SCOTUS approval is a done deal, though conservatives may draw hearings out to get out the vote. Even if Biden wins, even if the Senate turns (unlikely), they will get it done in Lame Duck. We need to not allow our political energy be drained trying to fight the inevitable like we did with that electoral college nonsense. That’s a dangerous form of denialism that allows us to be manipulated. We liberals must focus on other ways to manage what’s to come and on the election. I truly hope the media starts openly acknowledging that this thing is over and talking about what that means instead of drawing out the controversy and so diversion in order to pump ratings.

If we end up with Trump for another 4 years with a SCOTUS unwilling to limit his powers, my guess is we have a totalitarian president for life. He has already said he’d go for a third term.

EOS, I am not making shit up and pretending they are your beliefs. *YOU* said that you see abortion as first-degree murder. I guess it was an assumption on my part that that opinion means that you want women to go to prison for the rest of their lives. It bodes well that you do not think murderers need to go to prison for so long if we are going to have meaningful prison reform based in a Scandinavian model. I am sorry that I made that assumption about you based on how evil your opinion about abortion is. I assumed that since you are gun-ho to make women second class citizens and take away the very most fundamental human right to control one’s own body, that meant you were also evil enough to want to put them in prison too.

EOS, oh there are things that are WAY more evil than abortion! If you want to see it, look in the mirror! People who would try to control women’s bodies in the way that you propose are so much eviler than women making medical decisions about their own bodies are. People like you who try to manipulate people’s emotions by pretending that fetuses are babies or children are evil.

Wobblie, I don’t know why others don’t like Rogan but I tried to listen to his podcast once and I found it way too sexist for my taste. I don’t remember specifics though. Lynne and JH are such effective proofs of the thesis Geenwald puts forth. Winning the culture war Is more important than being politically effective. Given that premise it is quit understandable to simply dismiss a phenomenon that you do not understand and cannot relate to as “sexist”. Details are unimportant. My cultural leaders proclaimed this as “sexist” I do not need to engage in any kind of critical thinking of my own. EOS follows this same type of behavior. Bushs war on terror followed the ssme logic. Your either with us or against us. That is why you blame me for Trump. The fact that the Democrats didnt give me a reason to vote for them is immaterial, it was my yribal duty to vote Democrat. I know I am slow witted, but I have the duty to make my own decisions. To make informed choices, requires that I understand, at least in some fashion what others think and want. Life must be so much simpler when others( no doubt smarter than me) do sll the decidion making.

  92. Posted September 23, 2020 at 8:38 pm | Permalink

EOS, every cell in my body is human and some of them are even alive but I assure you, having parts of my body surgically removed is not more of a moral issue than when a woman has cells that aren’t even hers removed from her body. I agree that the world will be a better place without abortion which is why I work to make sure that other forms of birth control are accessible and affordable. Planned Parenthood has done a good job of this. It is ironic that they are hated so much as they have prevented way more abortions than any other organization in our country. I know this isn’t about preventing abortions for you because you don’t support the one thing that we know prevents abortions. The ONLY other real reason to be against abortions is a desire to control women’s bodies and their sex lives. I mean we could prevent abortions just as well by controlling men’s bodies but those solutions are seldom mentioned except to make certain points by being absurd. But that is a pretty big sign that points to the sexism at hand. If you think it is ok to mandate that a woman use her body to grow a child she doesn’t want and you do not think it is ok to mandate that all men get vasectomies at puberty (after freezing some sperm in case they want children), that is a sexist stance. Especially since the vasectomies are less harmful to health, less painful, and generally just a little snip snip. Often reversible even!

Wobblie, I still have no idea what point you think I should learn but it sounds to me like you
and Greenwald have a problem with people not giving men like Rogan the attention you seem to think that white men like him are entitled to. He is a bro and I put him on par with guys like Sean Hannity and Alex Jones and Rush Limbaugh but the liberal version. Not worth the time to listen to.

You do not have a tribal obligation to vote for Democrats. However, if you care about issues like women’s rights, climate change, and yes marijuana rights, the best way to bring about those kinds of policies is to vote for the best of two candidates in the general election. Those who don’t are rightly blamed for the outcome.

I blame you for Trump because you did not vote for HRC in the general election and therefore you actually are partly to blame. Not as much as those who actually voted for Trump of course but your vote had consequences. I also blame non-voters because not voting, like protest voting is ultimately a vote for the winner. It is not my fault that you don’t like those consequences or that you don’t like it when they are pointed out to you.

As you point out correctly, the way we go about enforcing marijuana laws is extremely racist. On that point, I wonder if Biden could be persuaded to sign a bill legalizing marijuana. I suspect he can. There is no point persuading Harris because she is already pro-legalization (I am not at all surprised that you would think otherwise. God forbid you pay attention to what a woman says!). Biden seems open to criminal justice reform. That certainly could be how a man like Biden could be persuaded to change. He may not ever be in favor of total legalization but he probably could be persuaded to decriminalize on the federal level, leaving it up to the states.

But you know White Man Rogan might not get his way totally so he is going to threaten to vote for Trump? All that shows is that he is an asshole who doesn’t care about how many people are going to die from COVID or how many kids are going to be in cages or how many women are going to have their uteruses removed, or how many are going to die from the effects of climate change or how woman are in real danger of legally losing their civil rights. I still see no reason to listen to him other than perhaps to figure out how he thinks and what about him appeals to his audience. I personally do not have the stomach for it so I will let the politicians do that work.

Florida reported 2,590 new cases of COVID-19 on Wednesday along with 202 more residents’ deaths.
The state is now up to 690,499 confirmed cases, 13,618 resident deaths and at least 164 non-resident deaths from COVID-19. At least 42,941 hospitalizations have been attributed to the novel coronavirus since the start of the outbreak, according to the state health department’s dashboard.
