National Emergency

This afternoon, just short of the Friday deadline, the U.S. Senate overwhelmingly passed a bipartisan spending bill that would avoid another shutdown. The compromise bill, which passed with only 16 Senators voting against it, included $1.375 billion for the construction of a 55 mile long fence of steel slats, significantly less that the $5.7 billion for a wall that Donald Trump was demanding when he shut down the government this past January.

This, as you might imagine, didn’t exactly sit well with the far right, who have made it clear that they’ll settle for nothing short of the massive concrete border wall that Donald Trump promised on the campaign trail. Laura Ingraham called the compromise bill a, “total scam,” and Ann Coulter warned that, if he signed this bill, it word be the end of Trump’s presidency. Hearing that the President was going to sign the bill, Coulter said, “Trump has just agreed to fully open borders.”

Trump, for what it’s worth, really didn’t have a choice. Another shutdown would have affectively killed his chances for a 2020 victory… a victory he desperately needs if he hopes to avoid indictment.

But, by signing this compromise bill, he does run the ver real risk of pissing off his far-right base… which is why he not only signaled this afternoon that he’d be signing the bill, but also declaring a national emergency on our southern border, allowing him to circumvent Congress.

Here’s how Senate Majority Leader Mitch McConnell announced the President’s position today.

This, of course, is clearly unconstitutional. The Justice Department, as we learned tonight, warned the White House that a declaration like this would be blocked by the courts, but yet it looks like Donald Trump, with no other good choices in front of him, has decided to go ahead and take us into a protracted and costly court battle over an unnecessary wall, just so that he can save face with his more racist and reality-challenged supporters. In more normal times, elected Republicans, who used to talk passionately about the dangers of “executive overreach,” would have been in the streets, demanding that Congress do its constitutional duty and stand up to the President. Now, though, not so much.

The thing is, we know this isn’t a national emergency. We know this because illegal immigration has been dropping for years, and Trump himself just recently conceded that the southern border is already “tight.” In fact, there’s still unspent money in the federal budget for border security from last year. And, if the southern border was a national emergency, why is it just becoming one now? Why wasn’t it a national emergency two years ago, when the Republicans controlled every level of power, and were instead focused on passing tax cuts for the rich and gutting our environmental agencies?

The truth is, this is all manufactured bullshit. The southern border wasn’t even mentioned among the top threats being faced by our country in the recent Worldwide Threat Assessment of the U.S. Intelligence Community. But here we are, discussing a ridiculous border wall because our President, beset by numerous criminal investigations, desperately needs to retain the support of his most diehard followers… the racists who ate it up when he promised them back in 2016 that he’d give them a “big, beautiful wall” to protect us from brown people from from shithole countries.

Please, if you can make a little time in your schedule, call your elected representatives in Washington right now and remind them that they have a constitutional duty to stand up for the rule of law, and protect our nation from would-be authoritarians who would attempt to consolidate power by exploiting a manufactured “crisis.” [It’s something we’ve seen before.] So, please, if you can, call your Representative and Senators, regardless of whether they’re Republican or Democrat, and ask that they not allow Donald Trump to take us down this slippery slope. And, when you have them on the phone, maybe also mention that we really do have legitimate national emergencies that demand real, decisive action, like gun violence and climate change.

The bust of Alben Barkley in McConnell’s office is weeping. In February of 1944, Senate Majority Leader Barkley stood up to President Roosevelt on a matter of executive overreach, asserting the powers of Congress. This so angered FDR that Barkley’s chances of being named as FDR’s running mate that summer went to zero. (This interpretation comes from Barkley’s memoirs.) McConnell’s announcement about the Dontard’s emergency declaration is one more act of evil and authoritarian enabling he’s committed. If he had any sense of history, he’d turn the bust of Barkley around so as not to be reminded of how he should be acting.

How many National Emergencies are currently in effect? Unconstitutional in the sense of not being IN the Constitution or…what? Because if not being in the Constitution makes something unconstitutional then just about all the laws passed since are unconstitutional. Are Special Counsels in the Constitution, etc?

    John Brown,

Disprove circumstantial evidence? Or disprove your inferences? You can’t even keep what you are talking about straight. You are advocating for the delegitimizing of the our president until he can disprove the CONCLUSIONS OF YOUR THEORY. The theory, you hold onto, is, as it stands now, necessarily based on INFERENCES you are making based upon circumstantial evidence. So you want Trump to disprove your inferences? Please tell me you understand how stupid it is for John Brown to request that Trump disprove John Brown’s inferences.

There are front line battles in the war of ideas. You will never be deployed there, John Brown. Time to go back to stocking your supply closet.

The U.S. Constitution is pretty specific
    Section 8

    1: The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

Article II of the Constitution spells out the Executive Authority. The President does not have the power “to pay the Debts and provide for the common Defence and general Welfare of the United States; ”

Trump might as Commander and Chief order the military to build the wall–but he has no authority to pay for it. That is why the Government periodically shuts down. That will be the constitutional crises. When Trump accrues debt that our Congress has not authorized payment for.

Trump doesn’t need to declare an emergency to confiscate El Chopo’s bank accounts and properties. Estimates are his net worth is between $1 and $14 billion. He doesn’t need to declare an emergency to use our National Guard to build the wall. Trump has plenty of options that would withstand the courts.

I don’t think that declaring a National Emergency, even under these circumstances, is unconstitutional. At the very least, such actions have passed muster in the past even when the results were much much more heinous than simply wasting money with a border wall. At least Trump isn’t rounding up citizens and putting them in camps which is something FDR did after declaring a national emergency.

With that said, I still think it is really stupid of him to do this because it sets a precedent. If the GOP has any sense, they will overrule this and hope they can get the Democrats on board. They might not though because as a strategy, allowing Trump to do this would mean that if the Democrats can win the WH back in 2020 (and there is a good chance that they might), they can declare things like gun violence a national emergency or they can declare the lack of universal healthcare is an emergency or any number of things.

I hope though that Congress can act in a true bipartisan manner and put some goddamn limits on the office of the president.

How do you deter & prevent this from happening again?
Simply by terminating employment of those responsible?
Simply by conducting a few ‘non-threatening’ investigations?
    Or by:
Prosecuting those responsible to the fullest extent of the law?
Setting up new checks & balances and oversight designed to increase transparency?
Provide OIG office(s) w/ funding inc (size) ++ authority?
Provide select committees w/ access and in-house viewing of non NAT SEC CLAS material?
Provide a check on Directors/Dep Directors/Asst Directors of all such ABC agencies?
Establish ‘financial checks/reviews’ of those in senior (critical) positions (audits) + direct family (close proximity)?
Transparency and Prosecution is the only way forward to save our Republic and safeguard such criminal and treasonous acts from occurring again.
While some want to quietly remove those responsible and go about our business (save face on the World Stage), those in control, understand, this band-aid will simply not work.
Nobody should be above the law (no matter how massive the spider-web is (entangled)).

    Jean,

I have reasons to SUSPECT HW is right that IL is still posting despite your claims. Not sure about the poetry guy but other posts, under different names, over the past months, have had a matching ” voice”and and similar thought processes, imo . It was not too hard to tell when somebody was fake posting. Somebody was fake posting under my name several times but I did not bother even pointing it out. I also already had reason to suspect that you know for a for a fact that multiple people were posting under fake names because you have already hinted at that knowledge several times. Who cares?

Assuming there is some misassignment happening, why should you care if HW is misassigning a particular voice to a person? You have already expressed your support of people using other peoples pseudonyms and therefore you have shown support for the chaos which that such a practice will inevitably bring. So it makes zero sense, imo, that you would try to gaslight HW for assuming certain posts are coming from IL. Even if HW decided to just use the rules of the game you wanted to play as an excuse to attack “a long gone IL” it is fair play, within a game, you wanted play.

Imo, if people don’t like somebody’s argument then they should attack the argument and not resort to gas lighting and attacks against the person. Imo, it is not so bad to have occassional humorous breaks like the limerick guy brings but that should only be after there have been sincere attempts to counter arguments with reasoning and evidence.

    These are just my opinions.

    “HW does not employ facts”

Hahahaha, what?! Not only do I use facts, I correct your use of facts just about every time you post a link. It’s happened so many times you are numb to it I suppose. Incredible irony.

FF is the king or queen of gaslighting. It’s really their only trick. It’s like Dr.Phil, Roger Stone, and Pootin had a baby and called it FF.

This entire comment thread could be a parody. I can only hope it amuses someone.

There are maybe 5 people who give a shit about what goes on here, and the author of the blog isn’t one of them. I’m bored too. Time to retire. Enjoy yourselves. It’s the most flacid circle jerk ever.

JH, agreed. While occasional mental masturbation feels good, it does in fact make you go blind in excess.
