Nearly 500 former federal prosecutors agree… what Trump did, as detailed in the Mueller report, constitutes felony obstruction of justice

This afternoon, a letter titled Statement by Federal Prosecutors went up on Medium. The document, which has now been signed by over 450 former federal prosecutors, states that the Mueller report contains sufficient evidence to charge Donald Trump with felony obstruction of justice. [He cannot be charged while in office according to Department of Justice guidelines, but, as I understand it, the Justice Department would be able to bring charges against him upon leaving office.] “Each of us believes that the conduct of President Trump described in Mueller’s report would, in the case of any other person…” the letter states, “result in multiple felony charges.” This, of course, runs very much contrary to Attorney General William Barr’s summary of the Mueller report, which essentially said that the President did not commit obstruction.

Here’s how the letter begins.

The letter then goes on to lay out the evidence as presented in the Mueller report… Here, according to these 450+ well-respected former prosecutors from both political parties, is a true and accurate summary of that evidence.

· The President’s efforts to fire Mueller and to falsify evidence about that effort;

· The President’s efforts to limit the scope of Mueller’s investigation to exclude his conduct; and

· The President’s efforts to prevent witnesses from cooperating with investigators probing him and his campaign.

Attempts to fire Mueller and then create false evidence

Despite being advised by then-White House Counsel Don McGahn that he could face legal jeopardy for doing so, Trump directed McGahn on multiple occasions to fire Mueller or to gin up false conflicts of interest as a pretext for getting rid of the Special Counsel. When these acts began to come into public view, Trump made “repeated efforts to have McGahn deny the story” — going so far as to tell McGahn to write a letter “for our files” falsely denying that Trump had directed Mueller’s termination.

Firing Mueller would have seriously impeded the investigation of the President and his associates — obstruction in its most literal sense. Directing the creation of false government records in order to prevent or discredit truthful testimony is similarly unlawful. The Special Counsel’s report states: “Substantial evidence indicates that in repeatedly urging McGahn to dispute that he was ordered to have the Special Counsel terminated, the President acted for the purpose of influencing McGahn’s account in order to deflect or prevent scrutiny of the President’s conduct toward the investigation.”

Attempts to limit the Mueller investigation

The report describes multiple efforts by the president to curtail the scope of the Special Counsel’s investigation.

First, the President repeatedly pressured then-Attorney General Jeff Sessions to reverse his legally-mandated decision to recuse himself from the investigation. The President’s stated reason was that he wanted an attorney general who would “protect” him, including from the Special Counsel investigation. He also directed then-White House Chief of Staff Reince Priebus to fire Sessions and Priebus refused.

Second, after McGahn told the President that he could not contact Sessions himself to discuss the investigation, Trump went outside the White House, instructing his former campaign manager, Corey Lewandowski, to carry a demand to Sessions to direct Mueller to confine his investigation to future elections. Lewandowski tried and failed to contact Sessions in private. After a second meeting with Trump, Lewandowski passed Trump’s message to senior White House official Rick Dearborn, who Lewandowski thought would be a better messenger because of his prior relationship with Sessions. Dearborn did not pass along Trump’s message.

As the report explains, “[s]ubstantial evidence indicates that the President’s effort to have Sessions limit the scope of the Special Counsel’s investigation to future election interference was intended to prevent further investigative scrutiny of the President’s and his campaign’s conduct” — in other words, the President employed a private citizen to try to get the Attorney General to limit the scope of an ongoing investigation into the President and his associates.

All of this conduct — trying to control and impede the investigation against the President by leveraging his authority over others — is similar to conduct we have seen charged against other public officials and people in powerful positions.

Witness tampering and intimidation

The Special Counsel’s report establishes that the President tried to influence the decisions of both Michael Cohen and Paul Manafort with regard to cooperating with investigators. Some of this tampering and intimidation, including the dangling of pardons, was done in plain sight via tweets and public statements; other such behavior was done via private messages through private attorneys, such as Trump counsel Rudy Giuliani’s message to Cohen’s lawyer that Cohen should “sleep well tonight, you have friends in high places.”

Of course, these aren’t the only acts of potential obstruction detailed by the Special Counsel. It would be well within the purview of normal prosecutorial judgment also to charge other acts detailed in the report.

We emphasize that these are not matters of close professional judgment. Of course, there are potential defenses or arguments that could be raised in response to an indictment of the nature we describe here. In our system, every accused person is presumed innocent and it is always the government’s burden to prove its case beyond a reasonable doubt. But, to look at these facts and say that a prosecutor could not probably sustain a conviction for obstruction of justice — the standard set out in Principles of Federal Prosecution — runs counter to logic and our experience.

As former federal prosecutors, we recognize that prosecuting obstruction of justice cases is critical because unchecked obstruction — which allows intentional interference with criminal investigations to go unpunished — puts our whole system of justice at risk. We believe strongly that, but for the OLC memo, the overwhelming weight of professional judgment would come down in favor of prosecution for the conduct outlined in the Mueller Report…

And you caught that last part, right? If not for the Office of Legal Counsel (OLC) memo authored by Barr, and presented as an accurate summary of the Mueller report, it is the opinion of these former federal prosecutors, “the overwhelming weight of professional judgment would come down in favor of prosecution”. In other words, if Barr hadn’t interceded on the President’s behalf, and the Attorney General had just release the Mueller report, instead of his own reimagining of it, we’d now likely be talking about prosecution.

Speaking of Barr, he missed another deadline today, failing to comply with a Congressional subpoena to deliver Robert Mueller’s full, unredacted report. And, as a result, it looks as though the House will be voting on Wednesday to hold him in contempt of Congress. In a statement released today, House Judiciary Committee Chair Jerry Nadler said, “The Attorney General’s failure to comply with our subpoena, after extensive accommodation efforts, leaves us no choice but to initiate contempt proceedings in order to enforce the subpoena and access the full, unredacted report.” If I’m not mistaken, Nadler also raised the possibility of impeaching Barr for the first time.

As near as I can tell only 5 NXIVM folks are currently facing criminal prosecution where as some 200 Evengelical Baptist Preachers, and hundreds of Catholic Priest have pled to similar charges. So the only reason you bring up NXIVM is to try to score cheap political points. If you really cared about child sexual abuse, you would be screaming for criminal prosecutions of the Catholic Church and the Southern Baptist Convention for their criminal coverups that have gone on for decades.

    That’s how it “seems” to you. I try to discourage any tendency toward ‘faith’ or even ‘belief’. Belief is the death of intelligence. For example I was decided against Donald Trump until the last minute when it came out that there was a fraudulent claim in the Katie Johnson case by the plaintiff. If the lawsuit was true then that would have been strong evidence Trump was a wolf in sheep’s clothing. I saw the false claim and decided to take a chance that they were trying to frame him out of desperation.

    I make it a habit to gather all information I can find and consider it deeply. When something appears to be true after careful consideration of all the information I find I might roll the dice and test my perception. So far I have been correct over and over on current events. No collusion for example to cite a major one that people here railed against, not to mention attacked me personally over and over for telling the truth about.

If it were true that elements of US government, perhaps high level Executive Branch officials deliberately caused or conspired to cause 9-11 to happen I am pretty fucking sure that would be about the biggest deal ever. Chomsky is very perceptive, the liberal elite want nothing to do with him—when was the last time he was ever interviewed on MSM? For an understanding of the “Leader Principle” I recommend “My Struggle” by A. Hitler, and “The Doctrine of Fascism” by B. Mussolini. The Leadership Principles of Amazon is also an informative read. Most modern transnational Corporations utilize most of the basic principles in their organizational structures. Multi-level marketing schemes also generally follow the same principles. Of course many of these principles are also incorporated in Catholic Church doctrine, and emulated by mega-church preachers every where.

Biased or perceptive? The economy is doing great, wages are up the most for blue collar workers, minority unemployment is at historic lows. I’ve mentioned things like this before and you just denied it. Maybe the numbers aren’t real but I suppose they are just as real as numbers from the same sources in the past.

    Aloha HW, Yes people are hungry to hear what Chomsky has to say precisely because of the MSM’s persistent censorship of his ideas. You should spend more time reading, even those you disagree with. Economic numbers have pretty much been screwed up since Reagan’s days and his administration decision to include those in the military as being in the work force and employed. One of the key employment numbers is workforce participation rate, as this chart from the St. Louis Fed demonstrates the work force participation rate is still significantly below pre-2002 levels. If you look at the graph all the way to its inception in 1950, you can clearly see several trends. The first noticeable one is woman entering the workforce and the decline of single income households. You can also identify the Reagan change in statistical record keeping in 1980. As you can see the rate has barely changed under the “booming” Trump economy.

    Aloha HW, Yep. You can clearly see that there was growing weakness in the economy prior to the onset of the Great Recession. Obama’s ARRA (American Recovery Reinvestment Act) clearly stabilized a falling economy, but as all labor oriented economist said at the time, IT IS WAY TO SMALL, and the recession continues to today. Trumps tax give away’s have done nothing to alter things in any appreciable way. It was the Democrats failure to understand the consequences of this chart that led to Trumps election. His stupid tweet yesterday about the Lordstown plant being sold is just a small example of how clueless he is about the economy. The alleged purchaser of Lordstown is a company that lost 6 million last year, and this year has gross revenue of under 1 million so far this year. The 2020 election is up to the Democrats to loose. Trump is sure not doing anything that is going to help him win—which explains why he has to keep pumping his base up.

    HW, both Manufacturing Consent and The Banality of Evil are still in print, and I imagine can be had cheap at the used book store on Cross. Amazon’s leadership principles are online and only take a few minutes to read. Hitler’s Mein Kampf you probably have to buy new. Mussilini’s Principles of Fascism is online. The basic Leadership Principle is “Do as the leader says”, “If you follow the leader, you too might get to become a leader some day”. Chomsky’s and Arendt’s book demonstrate what happens to society when we follow that principle.

    Aloha HW, The NXIVM sex scandal, and the illegal campaign investigations have nothing to do with the “secret indictments”. Both of these investigations have gone on for years, and the criminal indictments have bee public for years. I want you to use your super powers to tell me when the Qanon secret indictments (I hear it is 72000 now) are going to be used. Your constant bob and weave on this issue is distressing.     Don’t know what you are trying to say. The sealed indictments are on pacer.gov. Bob and weave? How? They’ll be unsealed when they need to be. You want the date when it will start or something? I never claimed to know that.

    All I said about NXIVM is it funded Clinton and was funded by Bronfman and it is up on sex trafficking and related charges.

    Michel is additionally charged with transferring another $1 million of Low’s money to an unidentified independent committee involved in the 2012 election.

    This planet has been turning to desert for quite a while. Do you think carbon emissions are primarily at fault? You think carbon tax and everything that goes with that is the answer? It was about 18 years ago the Observer had their front page article on how it would look here in 20 years “if climatologists predictions come true”. Well, it doesn’t look anything like that. They had us practically dying of thirst but still being invaded by hordes of climate refugees. If anything it is cooler and wetter now than it was back then.

    It just seems like there are a lot of unknowns and renewable energy sources would be a smart move either way.

    I agree with the scientist that we are altering the climate which could have unforeseen consequences. Humans are powerful creatures. Our abilities are incredible.

    I’m tired of old people and their limited understanding of what the world could be and how we should and could live.

    Trump isn’t moving us forward in a way that I appreciate. I know you feel different and I respect that. The thing is that in the present it hards to know where he’s taking us. Only in retrospect will we really understand his presidency and it’s impact.
