Nearly 500 former federal prosecutors agree… what Trump did, as detailed in the Mueller report, constitutes felony obstruction of justice

This afternoon, a letter titled Statement by Federal Prosecutors went up on Medium. The document, which has now been signed by over 450 former federal prosecutors, states that the Mueller report contains sufficient evidence to charge Donald Trump with felony obstruction of justice. [He cannot be charged while in office according to Department of Justice guidelines, but, as I understand it, the Justice Department would be able to bring charges against him upon leaving office.] “Each of us believes that the conduct of President Trump described in Mueller’s report would, in the case of any other person…” the letter states, “result in multiple felony charges.” This, of course, runs very much contrary to Attorney General William Barr’s summary of the Mueller report, which essentially said that the President did not commit obstruction.

Here’s how the letter begins.

The letter then goes on to lay out the evidence as presented in the Mueller report… Here, according to these 450+ well-respected former prosecutors from both political parties, is a true and accurate summary of that evidence.

· The President’s efforts to fire Mueller and to falsify evidence about that effort;

· The President’s efforts to limit the scope of Mueller’s investigation to exclude his conduct; and

· The President’s efforts to prevent witnesses from cooperating with investigators probing him and his campaign.

Attempts to fire Mueller and then create false evidence

Despite being advised by then-White House Counsel Don McGahn that he could face legal jeopardy for doing so, Trump directed McGahn on multiple occasions to fire Mueller or to gin up false conflicts of interest as a pretext for getting rid of the Special Counsel. When these acts began to come into public view, Trump made “repeated efforts to have McGahn deny the story” — going so far as to tell McGahn to write a letter “for our files” falsely denying that Trump had directed Mueller’s termination.

Firing Mueller would have seriously impeded the investigation of the President and his associates — obstruction in its most literal sense. Directing the creation of false government records in order to prevent or discredit truthful testimony is similarly unlawful. The Special Counsel’s report states: “Substantial evidence indicates that in repeatedly urging McGahn to dispute that he was ordered to have the Special Counsel terminated, the President acted for the purpose of influencing McGahn’s account in order to deflect or prevent scrutiny of the President’s conduct toward the investigation.”

Attempts to limit the Mueller investigation

The report describes multiple efforts by the president to curtail the scope of the Special Counsel’s investigation.

First, the President repeatedly pressured then-Attorney General Jeff Sessions to reverse his legally-mandated decision to recuse himself from the investigation. The President’s stated reason was that he wanted an attorney general who would “protect” him, including from the Special Counsel investigation. He also directed then-White House Chief of Staff Reince Priebus to fire Sessions and Priebus refused.

Second, after McGahn told the President that he could not contact Sessions himself to discuss the investigation, Trump went outside the White House, instructing his former campaign manager, Corey Lewandowski, to carry a demand to Sessions to direct Mueller to confine his investigation to future elections. Lewandowski tried and failed to contact Sessions in private. After a second meeting with Trump, Lewandowski passed Trump’s message to senior White House official Rick Dearborn, who Lewandowski thought would be a better messenger because of his prior relationship with Sessions. Dearborn did not pass along Trump’s message.

As the report explains, “[s]ubstantial evidence indicates that the President’s effort to have Sessions limit the scope of the Special Counsel’s investigation to future election interference was intended to prevent further investigative scrutiny of the President’s and his campaign’s conduct” — in other words, the President employed a private citizen to try to get the Attorney General to limit the scope of an ongoing investigation into the President and his associates.

All of this conduct — trying to control and impede the investigation against the President by leveraging his authority over others — is similar to conduct we have seen charged against other public officials and people in powerful positions.

Witness tampering and intimidation

The Special Counsel’s report establishes that the President tried to influence the decisions of both Michael Cohen and Paul Manafort with regard to cooperating with investigators. Some of this tampering and intimidation, including the dangling of pardons, was done in plain sight via tweets and public statements; other such behavior was done via private messages through private attorneys, such as Trump counsel Rudy Giuliani’s message to Cohen’s lawyer that Cohen should “sleep well tonight, you have friends in high places.”

Of course, these aren’t the only acts of potential obstruction detailed by the Special Counsel. It would be well within the purview of normal prosecutorial judgment also to charge other acts detailed in the report.

We emphasize that these are not matters of close professional judgment. Of course, there are potential defenses or arguments that could be raised in response to an indictment of the nature we describe here. In our system, every accused person is presumed innocent and it is always the government’s burden to prove its case beyond a reasonable doubt. But, to look at these facts and say that a prosecutor could not probably sustain a conviction for obstruction of justice — the standard set out in Principles of Federal Prosecution — runs counter to logic and our experience.

As former federal prosecutors, we recognize that prosecuting obstruction of justice cases is critical because unchecked obstruction — which allows intentional interference with criminal investigations to go unpunished — puts our whole system of justice at risk. We believe strongly that, but for the OLC memo, the overwhelming weight of professional judgment would come down in favor of prosecution for the conduct outlined in the Mueller Report…

And you caught that last part, right? If not for the Office of Legal Counsel (OLC) memo authored by Barr, and presented as an accurate summary of the Mueller report, it is the opinion of these former federal prosecutors, “the overwhelming weight of professional judgment would come down in favor of prosecution”. In other words, if Barr hadn’t interceded on the President’s behalf, and the Attorney General had just release the Mueller report, instead of his own reimagining of it, we’d now likely be talking about prosecution.

Speaking of Barr, he missed another deadline today, failing to comply with a Congressional subpoena to deliver Robert Mueller’s full, unredacted report. And, as a result, it looks as though the House will be voting on Wednesday to hold him in contempt of Congress. In a statement released today, House Judiciary Committee Chair Jerry Nadler said, “The Attorney General’s failure to comply with our subpoena, after extensive accommodation efforts, leaves us no choice but to initiate contempt proceedings in order to enforce the subpoena and access the full, unredacted report.” If I’m not mistaken, Nadler also raised the possibility of impeaching Barr for the first time.

Aloha HW, So other than your belief that NXIVM is not right wing, you see no difference. As near as I can tell only 5 NXIVM folks are currently facing criminal prosecution where as some 200 Evengelical Baptist Preachers, and hundreds of Catholic Priest have pled to similar charges. So the only reason you bring up NXIVM is to try to score cheap political points. If you really cared about child sexual abuse, you would be screaming for criminal prosecutions of the Catholic Church and the Southern Baptist Convention for their criminal coverups that have gone on for decades.
For your info, multi-level marketing schemes are by their very nature and organization “right wing” groups. Central to them is the “cult of the leader”–join Amway (or what ever they call it now, and you will see that adoration of the leader is central). “Left wing” groups are by definition, egalitarian and democratic the exact opposite of multi-level marketing which requires that you slave for the one above you in the pyramid—Get it Pyramid, not a circle. The fact that some of them bundled money for Hillary only shows that they (like your man Trump) are pro-war, pro-corporatis. Chomsky, the gatekeeper said even if 9-11 was an inside job it doesn’t matter. We have much more important things to think about, he said. Hmmm, oookaaay…huh, wow! How would that not be REALLY fucking important if it is true? I mean people inside the government conspiring to do 9-11? I know you are serious about 9-11 truth so why haven’t you graduated from Chomsky by now? By the way I have a leftist pedigree that most people around here would envy, wobs.

Giving the countries wealth to the kleptocratic class that supports Trump belies any “destroying” of the “Obama/Bush/Clinton globalist”. No body gets everything right by the way. Edward S. Herman and Noam Chomsky analysis of how are system works would help you better understand the world you live in. The earlier book by Arendt would help you understand how people fit themselves into that world and ultimately can become complicit in great evil. Your dismissal of reading some one based on some one feelings about 9-11 will ultimately leave you very ignorant and unable to understand events and people around you.

That’s how it “seems” to you. I try to discourage any tendency toward ‘faith’ or even ‘belief’. Belief is the death of intelligence. For example I was decided against Donald Trump until the last minute when it came out that there was a fraudulent claim in the Katie Johnson case by the plaintiff. If the lawsuit was true then that would have been strong evidence Trump was a wolf in sheep’s clothing. I saw the false claim and decided to take a chance that they were trying to frame him out of desperation.

I make it a habit to gather all information I can find and consider it deeply. When something appears to be true after careful consideration of all the information I find I might roll the dice and test my perception. So far I have been correct over and over on current events. No collusion for example to cite a major one that people here railed against, not to mention attacked me personally over and over for telling the truth about.

It’s not Chomsky’s feelings I am criticizing. His statement indicates he would not consider it to be important IF IT WERE TRUE. If it were true that elements of US government, perhaps high level Executive Branch officials deliberately caused or conspired to cause 9-11 to happen I am pretty fucking sure that would be about the biggest deal ever. For sure there would be executions for treason if the law was followed. There is no way IF IT IS TRUE that it would not be a huge deal. You know that. Wake up. Chomsky is a gatekeeper, keeping liberals in their intellectual pen.

Aloha HW, As I mentioned earlier, and as a dolt I know this very well, people are not right all the time. Chomsky is very perceptive, the liberal elite want nothing to do with him—when was the last time he was ever interviewed on MSM? For an understanding of the “Leader Principle” I recommend “My Struggle” by A. Hitler, and “The Doctrine of Fascism” by B. Mussolini. The Leadership Principles of Amazon is also an informative read. Most modern transnational Corporations utilize most of the basic principles in their organizational structures. Multi-level marketing schemes also generally follow the same principles. Of course many of these principles are also incorporated in Catholic Church doctrine, and emulated by mega-church preachers every where.

You act like it’s a fact President Trump is consolidating power like some kind of fascist. That’s your bias talking. I see the President working to restore power to the people. Biased or perceptive? The economy is doing great, wages are up the most for blue collar workers, minority unemployment is at historic lows. Aloha HW, Yes people are hungry to hear what Chomsky has to say precisely because of the MSM’s persistent censorship of his ideas. You should spend more time reading, even those you disagree with. Economic numbers have pretty much been screwed up since Reagan’s days and his administration decision to include those in the military as being in the work force and employed. One of the key employment numbers is workforce participation rate, as this chart from the St. Louis Fed demonstrates the work force participation rate is still significantly below pre-2002 levels. If you look at the graph all the way to its inception in 1950, you can clearly see several trends. The first noticeable one is woman entering the workforce and the decline of single income households. You can also identify the Reagan change in statistical record keeping in 1980. As you can see the rate has barely changed under the “booming” Trump economy.

Obama’s ARRA (American Recovery Reinvestment Act) clearly stabilized a falling economy, but as all labor oriented economist said at the time, IT IS WAY TO SMALL, and the recession continues to today. Trumps tax give away’s have done nothing to alter things in any appreciable way. It was the Democrats failure to understand the consequences of this chart that led to Trumps election. His stupid tweet yesterday about the Lordstown plant being sold is just a small example of how clueless he is about the economy. The alleged purchaser of Lordstown is a company that lost 6 million last year, and this year has gross revenue of under 1 million so far this year. The 2020 election is up to the Democrats to loose. Trump is sure not doing anything that is going to help him win—which explains why he has to keep pumping his base up.

We’re talking about you, not me. Again, I ask you: of all the criticism of Trump that has been expressed on Mark Maynard’s blog, can you find a single response by you which does not attempt to deflect to the Democrats or Deep State Republicans? If so, point it out. If not, let’s move on to the next claim:

“HW is possessed by a pathological compulsion to grasp at any possible defense. Doesn’t matter how tenuous. Doesn’t matter how, ahem, cray.”

This is still my opinion after a couple years of observing you on this site. Am I wrong? Do you remember our first interaction, following Charlottesville? Do you still believe Richard Spencer and Jason Kessler are liberals who only pretend to be neo-Nazis, and the whole event was “stitched up” by them in order to make Trump look bad by association? That was pretty crazy in 2017, and it would be even crazier if your thinking hasn’t evolved since then. Spencer and Kessler did not cease to exist after Charlottesville. Has your opinion changed? Here’s your opportunity to make a case to everyone you’re not a conspiracy theory addled nut anymore.

You can deflect all you want, but your laughable interpretation of “true information” couldn’t be more off the mark. I get it that you like to fantasize about prosecuting Clinton, but you need to focus on reality. Trump is not squirming because the walls are closing in on Clinton. She didn’t pick Trump’s campaign manager, nor his national security adviser, who are both likely to be indicted. She didn’t attempt to obstruct justice by begging Comey to let Flynn go, and then fire him when he wouldn’t. It’s not Clinton who has to worry about Manafort or Flynn flipping on her. You’re so delusional I used to be mortified for you, but now I’m mostly just amused to see how many rotten apples you can keep pulling from the bottom of your crazy barrel. So please, keep the crazy fruit coming.”

Who is delusional now? Manafort is in prison and the President is fine. What’s going on with Michael Flynn? No flipping that I have seen. Nothing Mueller found incriminating for sure. In all likelihood he is about to be exonerated; fudged 302’s.

The Clinton Foundation is under investigation. The origin of the Trump investigation which she is at the center of is also under investigation. “A year from now, if everyone around Trump is in prison, it will still have nothing to do with Trump.”

“Who is delusional now?”, you ask. Why, you are! Do I need to point out that on October 29, 2017 neither Manafort nor Flynn, who you bring up, had been indicted but now one is in prison and the other awaits sentencing? They’re not the only ones and we haven’t seen the end of it either, because nearly everyone in Trump’s orbit has proven to be corrupt. Oh hey, about your “FACTS” on Michael Cohen, saying he was sent to prison for “Obama era crimes” is a funny way to describe his conviction for campaign finance felonies committed “in coordination with and at the direction of Individual 1,” But back to my point, exactly as I predicted you delude yourself that none of it has anything to do with Trump! Oh that didn’t happen. It’s your own candidate who lowered the bar on what is acceptable behavior and use of power in office or in the world. Double standards aren’t going to hold.

It’s over. Anyone can win. The only way to restore balance and functionality to democracy is to select someone for the office who shows respect for democracy and cares about more than him or herself. There are plenty of good candidates among the Dems who meet that bar. They have a lot of good policy and leadership ideas to talk about. And that are uniformly articulate and well informed and… reasoned. The mud thrown won’t stick or divert. We have too much work to do. Crazy orange man waving tiny orange man yelling insults from the sidelines only draws attention to his own pathetic neediness and pettiness. The high road is the only road to success for Dems or the country. The GOP is so far off the high road I’m
Not sure they’ll ever be able to navigate their way back.

Trump’s calling the Dem slate of 20 a bunch of names— sleepy, dopey, grumpy, etc is only going to make clear the urgent need to replace him for even those people inclined to support some of his policies. There is an audience on both sides for the kind of people who think discourse is name calling and chest pounding. They are loud on social media but have been shown to be tiny in the general population and easily dismissed. Like waving off an annoying housefly.

Re: Jho Low and Pras Michel their indictments on NEW CHARGES were UNSEALED last week so what are you talking about?

The feds have slapped new charges against fugitive Malaysian playboy Jho Low — this time for alleged campaign-finance violations connected to President Obama’s 2012 re-election.

The latest allegations accuse Low of transferring $21.6 million to ex-Fugees rapper Prakazrel “Pras” Michel, who then moved $865,000 of that money to “straw” donors who contributed to an Obama fundraising committee.

The new indictment against the pair, unsealed Friday in Washington, DC, says the money was destined to “Candidate A.”

The link to Obama was first reported by Bloomberg News.

Michel is additionally charged with transferring another $1 million of Low’s money to an unidentified independent committee involved in the 2012 election.

“Michel recruited his friends, associates, and others to act as straw donors to make contributions,” the indictment alleges.

It just seems like there are a lot of unknowns and renewable energy sources would be a smart move either way.

I agree with the scientist that we are altering the climate which could have unforeseen consequences. Humans are powerful creatures. Our abilities are incredible.

I’m tired of old people and their limited understanding of what the world could be and how we should and could live.

Trump isn’t moving us forward in a way that I appreciate. I know you feel different and I respect that. The thing is that in the present it hards to know where he’s taking us. Only in retrospect will we really understand his presidency and it’s impact.

Tax livestock so high only only the rich can afford meat; economically enforced veganism. That will be great. We’ll be so weak we won’t be able to do shit. No one will have the strength to resist when they begin taxing our farts with ‘fartsmart’ sensors and analyzing our poop in smart toilets and monitoring our personal CO2 emissions and our global footprint and our wrongthink level and on and on.

I’m an advocate of Tesla technology. Do you think that is limited in scope? Free wireless electricity from the Earth not green enough for you? To me it’s ironic to see you talk like that. By the way did you know Uncle John Trump had access to Tesla’s files?

New Q, baby and very topical. I hope for your sake they are not talking about THIS week.

Treason doesn’t pay well in the end.

Attempts by Dems, FAKE NEWS, and those ‘guilty of TREASON’ to shape the public narrative [prior to] by providing FALSEHOODS will FAIL.

“It is a waste of time to try to force someone to conform to lies. That’s true. Especially someone like me.”

I hope you get well someday, but I’m not very optimistic you will. My theory for the reason you have everything completely backwards is because you share the same animosity for the same people as Trump, first and foremost, Hillary Clinton. You are uncritical of his lies, because they appeal to you emotionally. No, nobody is forcing you to conform to Trump’s crazy lies. you just love that crazy shit. Good luck.

You lie about Hillary Clinton too. It’s true that members of a child trafficking sex slave cult were on the board of the Clinton Global Initiative and illegally bundled money to the Clinton campaign. You say it’s crazy to talk about that. Maybe reality is crazy, dude. Did you ever once in your life think about that? Anyone who actually deals with reality would seem crazy to you.

Not just any NXIVM/CGI members mind you but the source of funding to the cult to the tune of $150 million of the Seagram’s Liquor fortune; partners at Bronfman Rothschild. The Elite involved in child trafficking…Now where have we heard that before? Oh, yeah – I said a lot of things about that and so have a number of others on here. Whose comments are beating that ass today in light of what we know from the NXIVM trial?

Tell us more about the Trump N Tesla connection HW. I’m curious to see how you spin this out.

PS I’m guessing most ppl here know who Nicholas Tesla was and what he did. We don’t always know how you have woven such random elements into your Trump idolatry cosmology so May make comments to emphasize the apparent randomness.

I’ve told you about all I know: John Trump was tasked with reviewing Tesla’s notes for the government after he died. No spin. All you need to do is look it up.

Everything that uses AC power depends on Tesla’s inventions. I don’t think his car would have run on batteries. There is an induction motor in Musk’s vehicle I see…neato…

I’m just happy that MM allows a safe space for HW to express himself fully, completely, and in complete anonymity. My hope is that his catharsis here allows him to function in the real world adequately. Maybe there should be some community grant that could be used to defray costs, as it seems to be a useful service to continue. Is “Keep Ypsi Weird” still a thing?

You are not only ignorant but you ridicule people who tell the truth. It’s not just passively being dumb but intentionally working against true understanding. To me that is one of the worst things you can do outside of really heinous crimes. To be human is to use reason so to abuse the reasonable is anti-human.
