Special counsel Robert Mueller, in a memo filed in federal court this evening, requested that former Trump administration National Security Adviser Michael Flynn (seen above in happier times, chanting “lock her up” with Donald Trump) be sentence to as little as no time in prison, in spite of his having pleaded guilty to lying to the FBI about his communications with Russian ambassador Sergey Kislyak during the 2016 presidential campaign. Mueller explained in the memo that Flynn had earned this consideration by providing “substantial” assistance to investigators over the course of 19 interviews that have taken place since his guilty plea last December, not only on his own communications with the Russians, but those initiated by other members of the Trump transition team. [Get ready, Jared “back channel” Kushner. It looks as though the axe may be about to fall.]
Here are Mueller’s exact words about Flynn’s sentencing… “Given the defendant’s substantial assistance and other considerations set forth below,” he says in the document, “a sentence at the low end of the guideline range — including a sentence that does not impose a term of incarceration — is appropriate and warranted.” [Has Mueller got your attention now. Paul Manafort?]
While it’s not exactly clear from these new documents, which are very heavily redacted, what exactly Flynn gave investigators, it would appear to have been substantial, as Mueller says in the document that Flynn’s assistance has been instrumental to “several ongoing investigations,” including at least one criminal investigation against a person whose name has been redacted. [It’s just a guess, but I think it might rhyme with “Ronald Rump.”]
Here’s an excerpt from the addendum that accompanied Mueller’s sentencing memo.
Like a lot of folks, I was hoping for more. I wanted to know who, exactly, Flynn had provided evidence against, and what information he’d given to investigators. I’m happy, however, knowing that he’s been interviewed 19 times, and that Mueller feels as though his contributions have been helpful not only in his investigation into Russian collusion, but also other ongoing investigations into the criminal activities of the Trump organization… Still, tough, I would have loved to have seen Flynn’s “lock her up”-chanting ass thrown into prison… But, given the choice, I’m OK with letting him go if it means moving the case up the food chain toward Donald Trump, which is pretty clearly what’s happening here.

So, to sum up, we learned this evening that Flynn has been singing like a bird for an entire year, that he’s provided evidence of others on the Trump transition team having been in contact with the Russians, and that there are other cases moving forward, in addition to those being pursued by Mueller and his team, including at least one criminal case. This, as Joe Biden might say, is kind of a big fucking deal. In fact, it’s such a big fucking deal that Donald Trump has yet to even tweet once about it… not even one unhinged post about how “flipping” should be illegal.
update: It’s the next morning, and, uncharacteristically, there’s still not a peep from Donald Trump, who just keeps tweeting away about the possibility of a Chinese trade agreement. Maybe this is why.

The Executive Order itself has absolutely nothing to do with changing those eligible for trial by a military court to include civilians. And it applies only to crimes committed only after the effective date of the change (1 January 2019).
